1. Acceptance of Terms

By accessing and using Vertoxo ("the Service"), you agree to these Terms.

2. Description of Service

Vertoxo provides an AI-powered roleplay platform including character creation, sessions, and text generation.

3. Accounts

You are responsible for your account, credentials, and all activity under it.

4. Acceptable Use

You agree not to misuse the Service, break laws, harm others, or attempt to interfere with the platform. Specifically, you will not:

• Create or request content that depicts or involves minors (under 18) in any sexual, exploitative, or violent scenarios, even if fictional.
• Promote, facilitate, or engage in any real-world illegal activities, including but not limited to child sexual abuse material, exploitation, scams, or fraud.
• Attempt prompt injection, jailbreaking, or any other techniques to bypass the Service's safety or content filters.
• Use the Service for spam, unauthorized scraping, automated access, or commercial purposes without our prior written permission.
• Interfere with the Service's security, integrity, or operation.

5. Content

You retain ownership of your content. You grant Vertoxo a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to host, reproduce, display, distribute, modify (for formatting and AI processing), and use your content solely as necessary to operate, improve, and provide the Service.

6. Subscriptions & Payments

• Subscriptions renew automatically unless canceled.
• You may cancel anytime; access continues until the end of your billing cycle.
• Payments are non-refundable except where required by law.

7. Termination

We may suspend or terminate access for violations of these Terms or other legitimate business, legal, or operational reasons. We aim to act reasonably and fairly when doing so.

8. AI Disclaimer

The Service uses AI to generate content. Outputs may be inaccurate, fictional, or inappropriate. We do not guarantee accuracy or reliability, and you should not rely on AI-generated content for critical decisions.

9. Third-Party Services

The Service may rely on third-party providers. We are not responsible for their performance, availability, or data practices.

10. Liability

The Service is provided "as is". To the fullest extent permitted by law, we are not liable for indirect or consequential damages. Liability is limited to the amount paid in the past 12 months.

11. Dispute Resolution

These Terms shall be governed by the laws of the United States of America. Disputes will be resolved through binding arbitration. Class actions are not permitted.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revisions.
